STRATTON SALES LTD TERMS & CONDITIONS

1. PRICES ARE SUBJECT TO VAT AT RATE RULING AT DESPATCH.
2. MARKET FLUCTUATIONS MAY NECESSITATE ALTERATION OF PRICES WITHOUT NOTICE.
3. GOODS WILL BE CHARGED AT THE PRICES RULING AT THE DATE OF DESPATCH.
4. NETT DUE CASH 30 DAYS FOLLOWING DATE OF INVOICE.
5. ORDERS WILL BE SUBJECT TO CARRIAGE CHARGE.
6. PROPERTY IN GOODS: UNTIL STRATTONS SALES LTD HAS BEEN PAID IN FULL BY THE BUYER FOR GOODS SUPPLIED BY STRATTONS SALES LTD AND ANY OTHER BALANCES OUTSTANDING TO STRATTON SALES LTD, FROM THE BUYER AT THE DATE SUCH GOODS ARE INVOICED TO THE BUYER HAVE BEEN SUPPLIED.

A) SUCH GOODS REMAIN THE PROPERTY OF STRATTON SALES LTD ALTHOUGH THE RISK
THEREIN PASSES TO THE BUYER AT THE TIME OF DELIVERY AND THE BUYER SHALL IN DEMNIFY STRATTON SALES LTD AGAINST ANY LOSS OR DAMAGE THERETO.
B) WITHOUT PREJUDICE TO ANY OTHER REMEDIES STRATTON SALES LTD MAY REPOSSESS
THOSE GOODS AT ANY TIME FROM THE BUYER AND FOR THAT PURPOSE STRATTON
SALES LTD ITS AGENTS AND SERVANTS MAY ENTER ANY PREMISES UPON WHICH THE
GOODS ARE SITUATED.
C) THE BUYER HAS THE RIGHT TO AGREE TO SELL AND TO DELIVER THE GOODS TO ANY
SUB-PURCHASER BUT ANY SUCH TRANSACTION SHALL BE DEEMED TO BE MADE ON
BEHALF OF STRATTON SALES LTD (BUT WITHOUT IMPOSING ANY LIABILITY ON
STRATTON SALES LTD TO SUCH SUB-PURCHASER) AND THE BUYER SHALL HOLD THE
PROCEEDS THEREOF OR RIGHTS ARISING THEREFROM AGAINST THE SUB-PURCHASER
FOR AND ON BEHALF OF STRATTONS SALES LTD UNTIL SUCH TIME AS THE BUYER SHALL
HAVE MADE FULL PAYMENT FOR SUCH GOODS ARE SETTLED THE SAID OUTSTANDING
BALANCES.
D) IF THE BUYER USES SUCH GOODS IN THE COURSE OF MANUFACTURE OF OTHER PRODUCTS THE PROPERTY IN SUCH PRODUCTS SHALL PASS TO STRATTON SALES LTD TIME AS SUCH USE UNTIL STRATTON SALES LTD HAS BEEN PAID IN FULL. THE PROVISIONS OF (B) AND (C) OF THE CONDITION SHALL APPLY TO SUCH PRODUCTS.
E) NOTHING IN THE CONDITION SHALL CONFER ANY RIGHT ON THE BUYER TO RETURN
GOODS SUPPLIED BY STRATTON SALES LTD OR TO REFUSE OR DELAY PAYMENT THEREOF

7. ALL CLAIMS FOR NON OR PART DELIVERY OR DAMAGES MUST BE MADE IN WRITING WITHIN 10 DAYS FROM THE DATE OF DELIVERY.
8. SPECIAL GOODS ORDERED CAN TAKE 2-6 WEEKS FOR DELIVERY, STRATTON SALES LTD CANNOT ACCEPT THE RETURN OF ANY OF THESE GOODS UNLESS FAULTY.
9. A FUEL SURCHARGE APPLIES ON ALL DELIVERIES MADE BY STRATTON SALES OWN TRANSPORT.
